Terms of Service
These Terms of Service ("Terms") govern your access to and use of the website operated by Mohum Consulting LLC ("Mohum Consulting," "we," "us," or "our") and, where applicable, your enquiry through it. By accessing this website or submitting our contact form, you agree to these Terms. If you do not agree, please do not use the website.
Note on engagements: Paid services we provide to clients are governed by a separate written agreement (a statement of work, master services agreement, and/or data processing agreement). Where that agreement conflicts with these Terms, the signed agreement controls for that engagement.
1. Use of the website
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use this website for lawful, informational purposes. You agree not to misuse the website, interfere with its operation, attempt to gain unauthorized access, or use it in violation of any applicable law.
2. Enquiries & communications
Submitting our contact form does not create a client relationship, a contract, or any obligation on our part to provide services. Please do not send confidential or sensitive personal information through the contact form; share such information only after we have a written agreement and a secure channel in place. We will use the information you submit as described in our Privacy Policy.
3. Services & engagements
Our data analytics, business intelligence, automation, AI consulting, and software development services are provided only under a separate written agreement that defines scope, fees, deliverables, timelines, warranties, and responsibilities. Nothing on this website is an offer to provide services on particular terms, and descriptions of our services are for general information only.
4. Data protection & confidentiality
We respect the privacy and intent of the people and organizations whose data we handle. When we process personal data on a client's behalf, we act as a processor under a data processing agreement, on the client's documented instructions, and we apply appropriate safeguards — with heightened protections for sensitive and health-related data as described in our Privacy Policy. We do not sell personal data and do not use client data for any purpose other than delivering the engagement, except as the client expressly authorizes. Each party will protect the other's confidential information and use it only as needed to perform under the applicable agreement.
5. AI-enabled services
Some of our services use artificial intelligence and machine-learning tools. AI outputs can be probabilistic and may contain errors; they are intended to assist, not replace, professional judgment, and deliverables that rely on AI should be reviewed before being relied upon. We will not input a client's confidential or personal data into third-party AI systems in a manner inconsistent with the client's instructions or our agreement, and we do not use client data to train models for ourselves or third parties absent the client's explicit authorization.
6. Intellectual property
The website and its content — including text, design, logos, and marks — are owned by or licensed to Mohum Consulting LLC and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the website without our permission. Ownership of deliverables created during a paid engagement is determined by the applicable written agreement.
7. Acceptable use
You agree not to use the website to:
- violate any law or the rights of others;
- submit false, misleading, or unlawful content, or another person's data without authority;
- transmit malware, attempt to probe or breach security, or disrupt the service;
- scrape, harvest, or collect data from the website by automated means without our consent.
8. Third-party links & services
The website may reference or link to third-party sites or services that we do not control. We are not responsible for their content, policies, or practices, and your use of them is at your own risk and subject to their terms.
9. Disclaimers
The website and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or secure, or that information on it is accurate or complete. Warranties for paid services, if any, are set out exclusively in the applicable written agreement.
10. Limitation of liability
To the fullest extent permitted by law, Mohum Consulting LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the website. Our total liability arising from the website will not exceed one hundred U.S. dollars (US$100). These limits do not apply to liability that cannot be excluded under applicable law. Liability arising from a paid engagement is governed solely by the applicable written agreement.
11. Indemnification
You agree to indemnify and hold harmless Mohum Consulting LLC from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the website or violation of these Terms or applicable law.
12. Governing law & disputes
These Terms are governed by the laws of the State of Nevada, USA, without regard to its conflict-of-laws rules. The courts located in Nevada will have exclusive jurisdiction over any dispute arising from these Terms or the website, and you consent to that jurisdiction and venue, except where applicable law gives you the right to bring proceedings elsewhere. Nothing here limits any mandatory consumer rights you may have under the law of your country of residence.
13. Changes to these Terms
We may update these Terms from time to time. The current version is always posted here with its effective date. Material changes take effect when posted, and your continued use of the website constitutes acceptance.
